Terms of Service

Who we are

17H13 Studios builds and hosts websites for local shops and small businesses anywhere in the US. We're based in Brooklyn, NY. Email us at admin@17h13.com.

In these terms, "we" means 17H13 Studios. "You" means the business that signs up and the person signing up for it.

The free demo

• We may build a demo site for your business from public information, such as your name, phone, hours and services on map and business listings.
• The demo is free. You owe nothing unless you sign up.
• It's a private link, set so search engines don't list it. It comes down after 7 days.
• Ask us to take it down sooner and we will, the same day.

Plans and prices

• Shopfront: a $500 one-time build fee, then $179 a month. Includes 2 minor revisions a month. Major revisions are available at a discounted fee.
• Marquee: a $1,000 one-time build fee, then $499 a month. Includes a motion build, 10 minor revisions and 1 major revision a month, the talking site concierge and the review growth program.
• Enterprise: priced by written quote.

Every plan includes hosting, your domain connected and your Google Business Profile linked. What each plan includes is listed on our Plans page and in any quote we send you. Your plan and price are shown again on your payment page before you pay. Prices are in US dollars. If a tax applies, we show it before you pay.

Billing

• You pay by card on a secure payment page run by Stripe, our payment provider. We never see or store your card number.
• At checkout you pay the one-time build fee plus your first month. The monthly fee repeats on that date each month until you cancel.
• You get a receipt by email for every charge, with a link to your billing page. There you can update your card, see past receipts or cancel.
• If a payment fails, we email you and try again. If it isn't fixed within 14 days, we may take your site offline until it is, after we send you a written notice.
• We email you at least 30 days before any price change. You can cancel before it takes effect.
• Enterprise work is billed as set in your quote.

Going live

• Before your site goes live, you check every line on it and tell us what to fix.
• Your site goes live within a week after you choose a plan and your payment goes through.
• If a delay is outside our control, such as a domain registrar, we tell you and give you a new time.

What's not included

• Logo design, ads and email at your domain, unless your quote says so.
• Any promise about search rankings, traffic, calls or sales. We don't control Google or any other search engine, or what they show.

Your domain

• Your site lives on a domain registered to your business and paid by you, about $15 a year. It's always yours. We never hold it.
• No domain yet? We set it up with you, in your business's name.

Content you supply

• You're responsible for what you give us for your site: text, prices, photos and logos.
• You confirm it's accurate and that you have the right to use it.
• You keep ownership of it. You give us permission to use it to build, host and update your site.
• Your demo starts from public listings. Before going live, you confirm every detail is correct.

Calls and texts

• If you give consent on our form, we may call and text you at the number you gave us about your demo and our service. Consent is not a condition of purchase.
• Msg frequency varies. Msg and data rates may apply. Reply STOP to opt out, HELP for help.
• On plans that text your customers, such as missed-call replies and review requests, texts go only to people who contacted or bought from your business. Every text says how to opt out, and we honor every STOP right away. You agree not to ask us to text anyone else.

Cancelling

Cancel any time on your billing page, or by email to admin@17h13.com. There's no fee to cancel.

• Billing stops. Your site stays up until the end of the month you paid for, then comes down. Your domain stays yours.
• We don't refund time already paid for.
• Within 5 business days after your plan ends, we email you your site files and your content.

Our right to refuse or end service

• We can decline to build or host a site for any lawful reason. That includes content that is illegal, misleading or uses someone else's work without permission, and businesses we can't verify.
• If you break these terms, for example by not paying or by asking us to publish unlawful content, we can suspend or end your service after we email you.
• If we end your service for any other reason, we refund the time you paid for and didn't use, and send your site files.

Hosting

We host your site with third-party providers. We can't promise it will never go down. If it does, we work to restore it and tell you what happened.

Liability

As far as the law allows, our total liability to you is limited to what you paid us in the 12 months before the claim. We aren't liable for lost profits or indirect losses.

Changes to these terms

We email you at least 30 days before a change that affects you. If you keep your plan after that date, the new terms apply.

Law

New York State law governs these terms.
